DOCUMENT TITLE: Declaration of Sherman D. Lenske SUBJECT: Declaration pertinent to the various Wills and probate papers of L. Ron Hubbard PARTIES: Sherman Lenske BACKGROUND AND NOTES Executed by Sherman Lenske on 4 February 1986, just weeks after the announced death of L. Ron Hubbard, this Declaration contains several important facts. The first is that Lenske admits that he worked for Norton S. Karno, and he and his brother Stephen Lenske had been representing L. Ron Hubbard's "business interests" since 1977, the very year that HASI, Inc. had its corporate status revoked. Another significant admission is that Lenske had written the 15 December 1979 Will that named Norton S. Karno as the Executor of the estate of L. Ron Hubbard, and provided a waiver of conflict of interest for Sherman Lenske himself and his brother, Stephen Lenske, should they or any member of Karno's firm represent Karno in the event that Karno, as Executor, elected to put a business partnership ahead of the interests of Hubbard's estate. One other significant admission is that Lenske only assisted in the drafting of the 10 May 1982 Will and the 23 January 1986 Will (drafted sometime in 1985). Of course he couldn't say it because it's a secret they are still trying (and failing) to keep, but the person Lenske assisted was former Assistant Commissioner of IRS Meade Emory who was on assignment from the Treasury Department to restructure Scientology according to IRS code. DECLARATION OF SHERMAN D. LENSKE I, SHERMAN D. LENSKE, do hereby declare as follows: 1. I am an attorney at law, duly licensed and authorized to practice before all of the Courts of the State of California. ln addition, I am admitted to practice before the United States Tax Court and the United States Supreme Court. I am a principal in the law firm of Lenske, Lenske & Heller, A Law Corporation. 2. I received a Bachelor of Arts degree from the University of California at Los Angeles and an LLB degree from the School of Law, University of California at Los Angeles. 3. Lenske, Lenske & Heller was retained in the early part of 1981, to represent the business interests of L. Ron Hubbard. I and one other principal of the firm, namely Stephen A. Lenske, have represented various business interests of Mr. Hubbard since 1977. 4. While with the firm of Karno & Schwartz, A Professional Corporation, I drafted a pour-over Will for Mr. Hubbard, which was executed by him on December 15, 1979. A copy of this Will is attached hereto as Exhibit "A" and by this reference made a part hereof. Paragraph First and Paragraph Seventh of this Will specifically disinherits L. Ron Hubbard, Jr., also known as Nibs Hubbard. 5. In l982, I assisted in the drafting of a new pour-over Will for Mr. Hubbard, which was executed by him on May 10, 1982. A copy of this Will is attached hereto as Exhibit "B" and by this reference made a part hereof. Paragraph First and Paragraph Sixth of this Will specifica1ly disinherits L. Ron Hubbard, Jr., also known as Nibs Hubbard. 6. In 1983, I drafted a Codicil to the Last Will and Testament, dated May 10, 1982, which was executed by Mr. Hubbard on November 14, 1983. A copy of this Codicil is attached hereto as Exhibit "C" and by this reference made a part hereof. Paragraph First of this Codicil specifically disinherits L. Ron Hubbard, Jr., also known as Nibs Hubbard, also known as Ronald DeWoif. 7. In 1985, I assisted in drafting a new pour-over Will for Mr. Hubbard, which was executed on January 23, 1986 and is his last Will and Testament. A copy of this Will is attached hereto as Exhibit "D" and by this reference made a part hereof. Paragraph First and Paragraph Seventh of this Will specifically disinherits Lafayette Ronald Hubbard, Jr., also known as L. Ron Hubbard, Jr., also known as Nibs Hubbard, also known as Ronald DeWolf. 8. The foregoing is within my personal knowledge, and if called as a witness, I could testify to the same.
